    The Power of Posner: A Study of Prestige and Influence in the Federal Judiciary

    Some judges have a disproportionate influence over the American judiciary; existing research has shown Judge Richard Posner is one of those judges. Our goal was to identify and determine how Judge Posner’s influence has changed over time. To measure and track his influence, we collected and compared citation and invocation data from three distinct time frames. While these measurements are imperfect, they can help illustrate the level of influence and prestige Judge Posner enjoys. The existing literature led us to expect Judge Posner’s early citation rates to be low. After several years on the bench, the citation rates for each opinion should rise dramatically. By contrast, Judge Posner’s citation rates are exceptionally high from the outset while more recent opinions actually have lower citation rates

    Neil Gaiman’s use of a hyper-masculine American culture in American Gods sheds light upon the multiple issues surrounding a misogynistic society in which women are treated as sexual objects and punished for their independence as sexual beings. Gaiman’s efforts at highlighting these issues are discreet and hidden under layers of patriarchal expectations, but through the use of his protagonist, Shadow, Gaiman is able to provide an alternative to the society he represents. While he successfully illustrates this more “ideal” society, his endeavors fall short and are almost imperceptible throughout his novel. Gaiman’s work in American Gods, while lacking in its overall presence, brings attention to the issues within a hyper-masculine society and it is through this unique, feminist approach that Gaiman is able to present his strong argument for change

    The Impact of California\u27s Changing Environmental Regulations on Timber Harvest Planning Costs

    The primary purpose of this study is to establish basic and supportable information on the impact of environmental regulations on California’s forest products industry. More specifically, the study focused on the effects of changing forest practice regulations on timber harvest planning and preparation costs. A survey of wood-processing and forestry consulting firms was conducted in the Summer and early Fall, 2004 seeking data on Timber Harvest Plan (THP) preparation costs, a major component of the transactions cost in California’s timber market. Despite the short data collection period, 607 sample observations were obtained. Analysis of the sample data clearly indicate significant cost increases resulting from ever-intensifying forest practice regulations, especially as a result of rule amendments in the early 1990s. Over the 30-year span, THP costs increased at a compound annual rate of about 4%, above inflation. Around 1993, there was a dramatic increase in these costs as THP costs, increasing nearly 60% within one or two years. As a result, a typical THP costs around 30,000topreparetoday,whereas30yearsagoitcostlessthan30,000 to prepare today, whereas 30 years ago it cost less than 2,500 (in today’s dollars). But these increases only reflect harvest planning costs under routine conditions. California’s Forest Practices Act can force considerable alteration of logging operations, increasing logging costs which in turn reduce economic rents (a.k.a. “stumpage”) to timberland owners. Thus, California timberland owners are “squeezed” on both cost and revenue sides. Landowners facing uncompetitive returns from managing their lands for wildland resource values, like timber, are increasingly inclined to sell their land for higher returns. In California this frequently means conversion to housing, a far more environmentally degrading land use. In other words, California’s increasingly strict environmental regulations of forestland are, in many cases, having precisely the opposite effect from that which was intended. Well-publicized urban sprawl and urban migration to historically rural areas is evidence of this effect

    Electrodynamics of Magnetars IV: Self-Consistent Model of the Inner Accelerator, with Implications for Pulsed Radio Emission

    We consider the voltage structure in the open-field circuit and outer magnetosphere of a magnetar. The standard polar-cap model for radio pulsars is modified significantly when the polar magnetic field exceeds 1.8x10^{14} G. Pairs are created by accelerated particles via resonant scattering of thermal X-rays, followed by the nearly instantaneous conversion of the scattered photon to a pair. A surface gap is then efficiently screened by e+- creation, which regulates the voltage in the inner part of the circuit to ~10^9 V. We also examine the electrostatic gap structure that can form when the magnetic field is somewhat weaker, and deduce a voltage 10-30 times larger over a range of surface temperatures. We examine carefully how the flow of charge back to the star above the gap depends on the magnitude of the current that is extracted from the surface of the star, on the curvature of the magnetic field lines, and on resonant drag. The rates of different channels of pair creation are determined self-consistently, including the non-resonant scattering of X-rays, and collisions between gamma rays and X-rays. We find that the electrostatic gap solution has too small a voltage to sustain the observed pulsed radio output of magnetars unless i) the magnetic axis is nearly aligned with the rotation axis and the light of sight; or ii) the gap is present on the closed as well as the open magnetic field lines. Several properties of the radio magnetars -- their rapid variability, broad pulses, and unusually hard radio spectra -- are consistent with a third possibility, that the current in the outer magnetosphere is strongly variable, and a very high rate of pair creation is sustained by a turbulent cascade.Comment: 32 pages, submitted to the Astrophysical Journa

    A non-inertial two-phase model of wax transport in a pipeline during pigging operations

    The removal of wax deposit from pipelines is commonly accomplished using pigs. In order to avoid the formation of wax plugs in pipes, bypass pigs, which create a liquid jet to disperse the scraped deposit, are employed. Despite many One-Dimensional (1D) models have been developed to predict the dynamics of bypass pigs, the details of the interaction between the liquid jet and the debris have not been investigated numerically yet. In this work the fluid dynamics of a wax-in-oil slurry in front of a moving bypass pig is studied by means of three-dimensional (3D) numerical simulations. A mathematical model which couples the pig and the wax-in-oil slurry dynamics, solved in the pig frame of reference, has been developed. The results show that the pig quickly reaches an equilibrium velocity, and the pig acceleration is proportional to the square of the mixture relative velocity. Comparing the present with previous sealing-pig results it appears that the bypass flow is more effective in deterring plug formation. Moreover, the 3D fields have the advantage of showing the wax distribution in each pipe section whereas the 1D model cannot distinguish between deposited and suspended wax

    Organisational interventions for improving wellbeing and reducing work-related stress in teachers [Review].

    Background: The teaching profession is an occupation with a high prevalence of work-related stress. This may lead to sustained physical and mental health problems in teachers. It can also negatively affect the health, wellbeing and educational attainment of children, and impose a financial burden on the public budget in terms of teacher turnover and sickness absence. Most evaluated interventions for the wellbeing of teachers are directed at the individual level, and so do not tackle the causes of stress in the workplace. Organisational-level interventions are a potential avenue in this regard. Objectives: To evaluate the effectiveness of organisational interventions for improving wellbeing and reducing work-related stress in teachers. Search methods: We searched the Cochrane Central Register of Controlled Trials (CENTRAL), MEDLINE, EMBASE, PsycINFO, ASSIA, AEI, BEI, BiblioMap, DARE, DER, ERIC, IBSS, SSCI, Sociological Abstracts, a number of specialist occupational health databases, and a number of trial registers and grey literature sources from the inception of each database until January 2015. Selection criteria: Randomised controlled trials (RCTs), cluster-RCTs, and controlled before-and-after studies of organisational-level interventions for the wellbeing of teachers. Data collection and analysis: We used standard methodological procedures expected by Cochrane. Main results: Four studies met the inclusion criteria. They were three cluster-randomised controlled trials and one with a stepped-wedge design. Changing task characteristics One study with 961 teachers in eight schools compared a task-based organisational change intervention along with stress management training to no intervention. It found a small reduction at 12 months in 10 out of 14 of the subscales in the Occupational Stress Inventory, with a mean difference (MD) varying from -3.84 to 0.13, and a small increase in the Work Ability Index (MD 2.27; 95% confidence interval (CI) 1.64 to 2.90; 708 participants, low-quality evidence). Changing organisational characteristics@ Two studies compared teacher training combined with school-wide coaching support to no intervention. One study with 59 teachers in 43 schools found no significant effects on job-related anxiety (MD -0.25 95% CI -0.61 to 0.11, very low-quality evidence) or depression (MD -0.26 95% CI -0.57 to 0.05, very low-quality evidence) after 24 months. The other study with 77 teachers in 18 schools found no significant effects on the Maslach Burnout Inventory subscales (e.g. emotional exhaustion subscale: MD -0.05 95% CI -0.52 to 0.42, low-quality evidence) or the Teacher Perceived Emotional Ability subscales (e.g. regulating emotions subscale: MD 0.11 95% CI -0.11 to 0.33, low-quality evidence) after six months. Multi-component intervention: One study with 1102 teachers in 34 schools compared a multi-component intervention containing performance bonus, job promotion opportunities and mentoring support to a matched-comparison group consisting of 300 schools. It found moderately higher teacher retention rates (MD 11.50 95% CI 3.25 to 19.75 at 36 months follow-up, very low-quality evidence). However, the authors reported results only from one cohort out of four (eight schools), demonstrating a high risk of reporting bias. Authors’ conclusions: We found low-quality evidence that organisational interventions lead to improvements in teacher wellbeing and retention rates.     Getting Ahead of the Wildfire Problem: Quantifying and Mapping Management Challenges and Opportunities

    Wildfire is a global phenomenon that plays a vital role in regulating and maintaining many natural and human-influenced ecosystems but that also poses considerable risks to human populations and infrastructure. Fire managers are charged with balancing the short-term protection of human assets sensitive to fire exposure against the potential long-term benefits that wildfires can provide to natural systems and wildlife populations. The compressed decision timeframes imposed on fire managers during an incident are often insufficient to fully assess a range of fire management options and their respective implications for public and fire responder safety, attainment of land and resource objectives, and future trajectories of hazard and risk. This paper reviews the role of GIS-based assessment and planning to support operational wildfire management decisions, with a focus on recent and emerging research that pre-identifies anthropogenic and biophysical landscape features that can be leveraged to increase the safety and effectiveness of wildfire management operations. We use a case study from the United States to illustrate the development and application of tools that draw from research generated by the global fire management communit

    Intense Electromagnetic Outbursts from Collapsing Hypermassive Neutron Stars

    We study the gravitational collapse of a magnetized neutron star using a novel numerical approach able to capture both the dynamics of the star and the behavior of the surrounding plasma. In this approach, a fully general relativistic magnetohydrodynamics implementation models the collapse of the star and provides appropriate boundary conditions to a force-free model which describes the stellar exterior. We validate this strategy by comparing with known results for the rotating monopole and aligned rotator solutions and then apply it to study both rotating and non-rotating stellar collapse scenarios, and contrast the behavior with what is obtained when employing the electrovacuum approximation outside the star. The non-rotating electrovacuum collapse is shown to agree qualitatively with a Newtonian model of the electromagnetic field outside a collapsing star. We illustrate and discuss a fundamental difference between the force-free and electrovacuum solutions, involving the appearance of large zones of electric-dominated field in the vacuum case. This provides a clear demonstration of how dissipative singularities appear generically in the non-linear time-evolution of force-free fluids. In both the rotating and non-rotating cases, our simulations indicate that the collapse induces a strong electromagnetic transient. In the case of sub-millisecond rotation, the magnetic field experiences strong winding and the transient carries much more energy.     The efficacy of medial patellofemoral ligament reconstruction combined with tibial tuberosity transfer in the treatment of patellofemoral instability

    A systematic review of the literature was undertaken to evaluate the efficacy of medial patellofemoral ligament (MPFL) reconstruction combined with tibial tuberosity transfer (TTT) in the treatment of patellofemoral instability. Using PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses) guidelines, a systematic search was carried out to identify and review the published literature pertinent to MFPL reconstruction combined with TTT. Relevant studies were critically appraised with narrative data synthesis. Studies that met the eligibility criteria were suitable for appraisal and consisted of case series and therapeutic series (levels IV & III). All studies had inherent variations in outcomes reporting and limited follow-up. Combined treatment offers restoration of normal anatomy, thus adding clinical value to the currently recommended anatomic approach to MPFL reconstruction. Nevertheless, the current body of evidence does not determine the threshold at which patellofemoral axis requires the need for adjunctive distal realignment as opposed to MPFL reconstruction alone. This review highlighted numerous recurring limitations in the conduct and presentation of the studies, which inadvertently mitigated the interpretation of their results. Future priority should be awarded to larger randomised controlled trials utilising validated patient reported outcome measures
